Condamné à la peine de mort pour haute trahison, il a été exécuté le 10 janvier 1934. L'incendie du Reichstag servit de prétexte à Hitler pour établir sa dictature.  Marinus van der Lubbe était anarchiste selon les uns, militant communiste conseilliste selon les autres.  La condamnation à mort a été finalement déclarée illégale le 10 janvier 2008 par les services du procureur fédéral allemand.",
